- ADAMS ESQ is a special education law firm representing children with disabilities who have (or need) an Individualized Education Program (IEP).
  
  1. Case Acceptance or Declination. As with all law firms, ADAMS ESQ reserves the right to accept or decline representation of your case. Submission of this Case Evaluation Request does not establish an attorney/client relationship and no such relationship is implied.
  
  2. Records Review & Intake. If your case is accepted (subject to a full records review) ADAMS ESQ will request your child's educational records after receiving your completed Terms of Engagement. Records typically arrive within 5-7 business days (up to 45 days in Nevada), though holidays or school breaks may extend this timeline. We’ll schedule an introductory call with your assigned attorney to discuss your concerns and next steps. Please note that your attorney won't be able to provide detailed case analysis during this initial call, as a complete records review will still be pending.
  
  3. Modest Means Program. Depending on your annual household income and other factors, you may qualify for our Modest Means Program and will be charged a retainer of $1 (One Dollar). This valuable benefit means that we will handle your case on a contingency basis. If your case proceeds to mediation, hearing, or settles beforehand, your attorney will seek reimbursement of legal fees directly from the school district, charter school or other local educational agency—ensuring that quality legal representation remains accessible to your family.
  
  4. Out-of-Pocket Expense Reimbursement. If you've paid for evaluations, therapy, tutoring, or other services related to your child's special education needs, please gather all receipts and documentation from the past 2 (two) calendar years. Depending on the outcome of your case, you may be entitled to reimbursement for these expenses, and receipts will be required to support your claim. You can also include mileage at the IRS rate for any trips to and from educationally-related services and appointments.
  
  5. Due Process Complaint. Your assigned attorney will review all school records (we call this evidence), consult with you and then prepare a draft due process complaint for your review and approval. This will take at least a few weeks from the time all school records have been received and processed. After you approve your complaint, our staff will file it and serve the appropriate parties.
  
  6. Early Resolution Session (ERS). If you receive an invitation to participate in an Early Resolution Session from the school district after your case is filed, please notify our office immediately. Your attorney will provide specific guidance on how to respond and what to expect during this preliminary meeting.
  
  7. Mediation. Most special education cases settle at or shortly after ERS or a mediation. The mediations range from ½ day to an entire day. It is always preferrable to settle a due process case rather than risk losing or delaying services by proceeding to hearing. Importantly, special education law makes clear that parents and their attorneys who unreasonably delay case resolution might be held responsible for paying the school district or charter school’s legal fees.
  
  8. Due Process Hearing. Should your case proceed to a due process hearing, the proceedings typically span 2-3 full days but can extend to over a week and are usually virtual. Your presence throughout the hearing is essential, so please be prepared to set aside this time and make necessary arrangements for work, childcare and other obligations.
  
  9. Case Closure. Once your case is resolved, we will send you correspondence formally closing the case and ending our representation. This is customary “good housekeeping” for law firms. Of course, you should contact our office if the school district or charter fails to abide by the agreement or you would like to file a new case.
